My father has died and left behind 20,000 dinars. How should it be distributed to his heirs: his wife, two sons and three daughters?.
He died and left behind a wife, two sons and three daughters
Question: 100795
Praise be to Allah, and peace and blessings be upon the Messenger of Allah and his family.
If the father dies and leaves behind a wife, two sons and three daughters, then the wife gets one-eighth, because Allaah says (interpretation of the meaning):
“if you leave a child, they [wives] get an eighth of that which you leave”
[al-Nisa’ 4:12]
The rest goes to the children (males and females), with each male getting the share of two females, because Allaah says (interpretation of the meaning):
“Allaah commands you as regards your children’s (inheritance): to the male, a portion equal to that of two females”
[al-Nisa’ 4:11]
Based on that:
The wife’s share is 2500 dinars.
The share of each male is 5000 dinars.
The share of each female is 2500 dinars.
And Allaah knows best.
